A year after the tragic drowning of Malcolm-Jamal Warner, his spouse Tenisha Warner has initiated legal action against the actor’s mother, who manages his trust, claiming over $1.2 million in funds that she asserts are owed to her.
The lawsuit was submitted on Monday in the DeKalb County Superior Court located in Decatur, Georgia, targeting Pamela Warner, identified in the legal documents as the “successor trustee of the Warner family trust.”
The cherished actor passed away on July 20, 2025 due to a drowning incident while he was vacationing in Costa Rica at the age of 54.
Warner and Tenisha married on May 23, 2022, following the signing of a prenuptial agreement on May 15 of the same year. They have a daughter, whose name remains undisclosed.
According to the lawsuit, Warner, recognized for his role as Theodore Huxtable on the iconic 1980s sitcom “The Cosby Show,” had “agreed to purchase and maintain a term life insurance policy on his life in the amount of $1,000,000.00” with his spouse as the beneficiary, but did not fulfill this obligation.
In her claim, Tenisha Warner also contends that the actor did not provide her with the agreed annual payment of $16,000 for their marriage anniversaries, which has accumulated to $50,542.46; failed to contribute to a Roth Individual Retirement Account for her at the maximum allowable amount each year; and neglected to pay her a promised salary of $5,000 per month for her role as his chief of staff, totaling $195,000.
“Overall, the total amounts owed to the Plaintiff under the Agreement amount to no less than $1,276,042.46, along with prejudgment and post-judgment interest and the attorney’s fees and costs recoverable under the Agreement,” the lawsuit claims.
All agreements and financial stipulations are also detailed in the attached prenuptial agreement included with the lawsuit.
In a statement released to USdaily through her attorney on Tuesday, Tenisha Warner expressed that for the past year, she has “attempted to privately resolve my beloved husband’s complex estate and honor his final wishes,” adding that her husband “intended” to support her and their nine-year-old daughter and “was nearing completion of a new estate plan to update the outdated plan created in 1996 when he was only 26, well before we met and had our beautiful daughter.”
“Regrettably, he could not accomplish this before his passing. I have been struggling to support our daughter as a single parent and now as her only provider,” she stated. “Legally, I had no option but to take measures to safeguard our rights before any potential statute of limitations came into effect.”

The actor was protective of his wife and child’s privacy during his lifetime. In September 2025, Tenisha Warner shared a tribute on social media and announced the launch of a company in his honor with their young daughter.
“I can still hear my husband’s laughter, still feel the space he created for every aspect of me — every tear, every dream,” she reflected at that time alongside a series of family images.
On Monday, the actor’s mother shared an extensive message on his memorial Instagram account to commemorate the first anniversary of his death. “It is usually the parent who departs first, leaving the child or children to carry on with their lives. But what happens when the order is reversed and the child or children pass away first?” she wrote.
“This is the reality I faced on July 20, 2025. And this is what I woke up to on July 20, 2026,” his mother, who also managed Malcolm early in his career, expressed. “How can I be here when my child is not?”
